New York is now in Phase II of reopening after the COVID-19 shut-down. Still, many people remain concerned about what the new “normal” means when it’s still possible to contract the virus and perhaps face an untimely death. Having an updated estate plan can provide some relief from this anxiety, and you don’t have to leave home to accomplish it. Right now it is possible to execute a new or updated will using video technology without having to physically appear in your lawyer’s office.
Governor Cuomo made this possible by Executive Order No. 202.14 issued on April 7, 2020 (and subsequent extensions) (the “Order”).
By following the guidelines provided in the Order, you, your witnesses, your attorney and the notary public can complete a legally valid will without being present together in the same physical space. Instead, everyone can be connected using video technology.
If you want to update your will, Power of Attorney, Health Care Proxy, or Living Will (or create a new will) we encourage you to act now. You can stay safe at home while you memorialize your wishes for yourself, your estate and the people you care about.
The Order remains in effect through July 6, 2020 and may be further extended. Please contact us for additional details if you are thinking of changing your will or estate plan.
