The Emerging Technology, Privacy, and Cybersecurity practice group focuses on the legal, regulatory, and risk management challenges posed by cutting-edge technologies and the increasing complexity of data privacy and cybersecurity requirements.

Key Focus Areas:

1. Technology Transactions

  • Drafting and negotiating technology agreements, including software licenses, vendor agreements, cloud computing contracts, social media/influencers contracts and data-sharing agreements;
  • Ensuring compliance with privacy and cybersecurity terms in commercial deals;
  • M&A due diligence focusing on technology, privacy and cybersecurity issues.

2. Emerging Technology

  • GenAI and Machine Learning: Advising on responsible AI use, algorithmic accountability, bias, transparency, and compliance with AI laws like the EU AI Act;
  • Blockchain & Digital Assets: Legal structuring of token offerings, smart contracts, and compliance with financial and securities regulations, including the Genius Act or the proposed Clarity Act;
  • Internet of Things (IoT): Managing data security and liability risks related to connected devices.

3. Privacy and Data Protection

  • Conducting privacy impact assessments;
  • Developing and updating global privacy policies;
  • Advising on cross-border data transfers;
  • Privacy/data Protection litigation, including class actions;
  • Navigating privacy laws like:
    • GDPR (Europe)
    • CCPA/CPRA (California)
    • PIPEDA (Canada)
    • LGPD (Brazil)
    • India’s Digital Personal Data Protection Act.

4. Cybersecurity

  • Incident response planning and execution;
  • Breach notification compliance (globally);
  • Representing clients in cyber incident investigations and litigation;
  • Advising on frameworks like NIST, ISO/IEC 27001.

The emerging technology, privacy and cybersecurity practice group works closely with the litigation and arbitration teams to avoid/resolve disputes and provides support/counsel in litigation/arbitration contexts.
