Dunnington partners Ray Dowd and Olivera Medenica represent law professors supporting a challenge to the USPTO’s denial of a patent to owners of artificial intelligence systems. The legal issue is whether an “inventor” must be a human being under the Patent Act.
Dowd and Medenica submitted an amicus curiae or “friend of the court” brief on April 12, 2023, on behalf of Harvard Professor Lawrence Lessig, Fordham Law Visiting Professor Shlomit Yanisky-Ravid and others. The law professors argue that denying AI systems’ patents affects potentially hundreds of billions in investments and risks crippling the development of AI in the United States.
